2. Purpose

These general terms and conditions of sale govern access to, browsing of and the purchase of products through the website iamnue.com, as well as the rights and obligations of the parties.

Use of the website confers the status of user and entails full acceptance of these terms in the version published at the time of access.

3. Acceptance and documents forming the contract

By placing an order you declare that you have read and accepted these terms, the Return Policy, the Shipping Policy and the Privacy Policy, all of which form an integral part of the contract.

If you do not agree with any of their provisions, you must refrain from using the website and from placing orders.

4. Capacity to contract

To purchase products through this website you must be of legal age and have sufficient legal capacity to enter into a contract.

If you allow minors under your responsibility to use the website, you assume the consequences of the transactions carried out.

5. Registration and user account

Purchases may be made as a guest or through a user account. In the latter case, you undertake to provide truthful, accurate and up-to-date information and to keep it current.

You are responsible for safeguarding your access credentials and for all transactions carried out from your account. The account is personal and non-transferable.

6. Product information

IAMNUE sells products of third-party brands. Descriptions, technical specifications and images are prepared on the basis of information supplied by manufacturers and suppliers.

Photographs are indicative. Colour perception may vary depending on your device and its display settings, which shall not constitute a lack of conformity of the product.

The product range and its characteristics may be modified at any time. Such modifications shall not affect orders already confirmed.

7. Prices and taxes

Prices are shown in the currency corresponding to the market from which the website is accessed and are stated per unit.

For orders shipped to Spain and to the rest of the European Union, the prices displayed include applicable Value Added Tax, in accordance with consumer protection legislation.

For orders shipped outside the European Union, the transaction constitutes an exempt export and prices are displayed excluding Spanish Value Added Tax. Any customs duties, levies and import taxes payable at destination shall be borne by the recipient, in accordance with the Shipping Policy.

Delivery costs are calculated and displayed separately before the order is confirmed.

Prices and promotions may be modified at any time. The applicable price shall be that in force at the time the order is placed, as stated in the confirmation sent by email.

8. Ordering process

In accordance with Article 27 of Spanish Law 34/2002, the steps required to place an order are described below:

a) Selection of products and addition to the shopping basket.

b) Identification as a registered user or as a guest, and entry of billing and delivery details.

c) Selection of the delivery method and display of the corresponding costs.

d) Selection of the payment method and express acceptance of these terms.

e) Review of the order summary and confirmation by means of the payment button, the pressing of which entails an obligation to pay.

Before confirming your order you will be shown a summary setting out the products, the total price including taxes, the delivery costs and the delivery address, and you will be able to correct any input errors.

9. Formation of the contract

The contract is deemed concluded at the moment IAMNUE sends the order confirmation to the email address provided.

IAMNUE may decline an order only on objective and justified grounds, which will be communicated to you without delay, in which case all amounts paid will be refunded in full. The following shall be considered objective grounds:

a) Unavailability of the product due to an inventory error.

b) A manifest error in the price or description of the product.

c) Impossibility of delivering to the address provided.

d) Detection of well-founded indications of fraud or of breach of these terms.

The electronic document recording the contract will be archived by IAMNUE and will be accessible through your user account or upon request to customercare@iamnue.com.

10. Language of the contract

The contract may be concluded in Spanish or in English, according to the language selected on the website. In the event of any discrepancy of interpretation between versions of these terms, the Spanish version shall prevail.

11. Payment methods

The accepted payment methods are displayed during the purchase process. Payment is processed through payment service providers that apply their own security measures.

IAMNUE does not store complete payment card details.

You declare that you are the holder of, or are duly authorised to use, the payment method employed.

For orders paid in a currency other than the euro, the exchange rate applied is that in force at the time of the transaction. Any fees charged by your issuing institution are beyond IAMNUE's control.

12. Availability and manifest errors

Displayed availability is updated continuously, although discrepancies may arise as a result of concurrent orders.

In the event of a manifest error in the price or information of a product, IAMNUE will inform you and may elect either to maintain the order on the correct terms or to terminate it, refunding in the latter case the full amount paid.

13. Shipping and delivery

Delivery areas, timeframes and costs are set out in the Shipping Policy.

Delivery timeframes are estimates and are calculated in business days from confirmation of the order. The maximum delivery period shall be thirty (30) calendar days from conclusion of the contract, unless expressly agreed otherwise.

IAMNUE shall not be liable for delays attributable to causes beyond its control, in particular carrier incidents, customs procedures or events of force majeure, without prejudice to the rights afforded to you under clause 21.

14. Right of withdrawal and returns

You have a period of fourteen (14) calendar days to withdraw from the contract on the terms set out in the Return Policy, which forms an integral part of these terms.

That policy sets out the procedure, the time limits, the costs borne by you, the statutory exceptions and the model withdrawal form.

15. Legal guarantee of conformity

Products sold by IAMNUE are subject to the legal guarantee of conformity for a period of three (3) years from delivery, in accordance with Articles 114 et seq. of Spanish Royal Legislative Decree 1/2007.

In the event of a lack of conformity, you are entitled to have the goods brought into conformity by repair or replacement and, where this proves impossible or disproportionate, to a price reduction or to termination of the contract.

To invoke this guarantee, please write to customercare@iamnue.com stating your order number and the nature of the defect.

16. Intellectual and industrial property

The contents of the website — texts, photographs, videos, designs, trademarks, logos, source code and their selection and arrangement — are protected by Spanish and European intellectual and industrial property legislation and belong to IAMNUE or to third parties who have authorised their use.

The trademarks and names of the products sold belong to their respective owners and are used solely to identify the articles offered.

The reproduction, distribution, public communication, transformation or any other form of exploitation of the contents without prior written authorisation is prohibited.

17. User-generated content

When you submit comments, reviews, images, suggestions or other content, you warrant that you hold the necessary rights and that such content does not infringe third-party rights or applicable law.

By submitting it, you authorise IAMNUE to reproduce, publicly communicate and adapt such content for the promotion of its products and services, worldwide and for the maximum period permitted by law, without consideration.

You may revoke this authorisation by writing to customercare@iamnue.com. IAMNUE may remove content that is unlawful, offensive or contrary to these terms.

18. Prohibited uses

The website must be used in accordance with the law, good faith and these terms. In particular, the following is prohibited:

a) Using the website for unlawful purposes or purposes harmful to third parties.

b) Introducing or disseminating viruses or any code liable to damage the systems.

c) Systematically extracting, reproducing or reusing the contents, including by automated means.

d) Impersonating third parties or providing false information.

e) Circumventing security or access restriction measures.

IAMNUE may suspend access for those who breach the foregoing.

19. Automated systems and agents

For the purposes of this clause, an agent means any software or service that performs autonomous or semi-autonomous actions on behalf of or at the instruction of a third party.

Access by agents is conditional upon their identifying themselves as such in the corresponding field of each request, not simulating human behaviour, not circumventing verification systems and complying with the technical restrictions in place.

IAMNUE may limit or prevent access by agents that do not comply with these conditions.

20. Third-party links and services

The website may contain links to, or embedded functionality from, third parties. IAMNUE does not control such content and is not liable for its accuracy, availability or lawfulness.

Access to third-party sites is at the user's sole responsibility and is governed by the terms and privacy policies of their respective owners.

21. Liability

IAMNUE is liable for the proper performance of the contract on the terms provided for in consumer protection legislation.

The limitations of liability shall not apply in respect of damage caused by wilful misconduct or gross negligence, nor in respect of personal injury, nor in any case where mandatory legislation precludes them.

Beyond such cases, IAMNUE shall not be liable for indirect damages or loss of profit, nor for interruptions or technical incidents affecting the website that are not attributable to it.

22. Force majeure

Neither party shall be liable for failure to perform its obligations where such failure is due to force majeure or unforeseeable circumstances, meaning unforeseeable or unavoidable events beyond its control.

Should such circumstances persist for more than thirty (30) calendar days, either party may terminate the contract, whereupon IAMNUE shall refund the amounts paid.

23. Data protection

The processing of personal data is governed by the Privacy Policy, drawn up in accordance with Regulation (EU) 2016/679 and Spanish Organic Law 3/2018.

Please note that the website operates on the Shopify platform, which acts as data processor and which may involve international data transfers, duly covered by the safeguards provided for under applicable law.

24. Relationship with Shopify

The website is powered by Shopify. However, any sale is concluded directly with IAMNUE, which is solely responsible to the customer for performance of the contract.

Shopify is not a party to the contractual relationship and is not liable for the products sold.

25. Severability

A declaration that any of these clauses is void or ineffective shall not affect the validity of the remaining clauses, which shall remain in full force.

The affected clause shall be replaced by another which, being valid, most closely approximates the intended purpose.

26. Amendments to the terms

IAMNUE may amend these terms at any time. The version applicable to each order shall be that in force and accepted at the time the order is placed; subsequent amendments shall not affect contracts already concluded.

The updated version will remain permanently accessible on this page.

27. Governing law and jurisdiction

These terms are governed by Spanish law.

Where the customer qualifies as a consumer, the competent court shall be that of the customer's domicile, and this clause shall in no way limit the rights afforded to the customer by the mandatory legislation of their country of residence.

In relations with customers who do not qualify as consumers, the parties submit to the courts of A Coruña, waiving any other jurisdiction to which they may be entitled.

28. Complaints and dispute resolution

You may address any complaint to customercare@iamnue.com. We undertake to respond as promptly as possible.

You are also entitled to refer the matter to the competent consumer protection authorities in your place of residence.
