2. Purpose of this policy
This policy describes how IAMNUE collects, uses, retains and discloses your personal data when you visit the website iamnue.com, place an order, create an account, subscribe to our communications or contact us by any means.
Please read it carefully before providing us with your data.
3. Data we process
Depending on your relationship with us, we may process the following categories of data:
a) Identification and contact data. Name and surname, postal address, billing and delivery addresses, telephone number and email address.
b) Account data. Username, access credentials, preferences and settings.
c) Transaction data. Products viewed, added to the basket or purchased, order history, returns, exchanges and cancellations.
d) Payment data. Payment method used, transaction confirmation and related information. IAMNUE does not store complete card details, which are processed directly by the payment service providers.
e) Communication data. The content of your enquiries, complaints and other communications with us.
f) Technical and browsing data. IP address, device identifiers, browser type, pages visited and interaction with the website.
Fields marked as mandatory in our forms are necessary for the purpose stated in each case. Failure to complete them will prevent us from processing your order, creating your account or handling your request.
4. Source of the data
The data comes from the following sources:
a) Directly from you, when provided through the website forms, when creating an account, placing an order or contacting us.
b) Automatically during your browsing, by means of cookies and similar technologies, on the terms set out in clause 11.
c) From our service providers, where they process data on behalf of IAMNUE in the course of the services engaged.
5. Purposes and legal bases
We process your personal data for the following purposes, on the legal bases indicated:
a) Order management and performance of the sale. Order processing, preparation, dispatch, delivery, returns and exchanges, and administration of the legal guarantee. Legal basis: performance of the contract (Article 6.1.b of the Regulation).
b) Management of your user account. Creation, maintenance and administration of the account and its preferences. Legal basis: performance of the contract (Article 6.1.b).
c) Invoicing and accounting and tax obligations. Issuing invoices, keeping accounting records and complying with tax and customs obligations. Legal basis: compliance with a legal obligation (Article 6.1.c).
d) Customer care. Responding to enquiries, complaints and requests. Legal basis: performance of the contract or legitimate interest in assisting those who contact us (Articles 6.1.b and 6.1.f).
e) Commercial communications. Sending news, promotions and content by email or other electronic means. Legal basis: your consent (Article 6.1.a). In the case of existing customers, communications relating to products similar to those already purchased are based on legitimate interest, in accordance with Article 21.2 of Spanish Law 34/2002, and you may object at any time.
f) Personalisation and targeted advertising. Recommending products and displaying advertising tailored to your interests, both on and off the website. Legal basis: your consent, given through the cookie management system (Article 6.1.a).
g) Fraud prevention and security. Identity verification, detection of fraudulent transactions and protection of the website and its users. Legal basis: legitimate interest in preserving the security of our operations (Article 6.1.f).
h) Analysis and improvement of our services. Aggregate analysis of website usage in order to improve our catalogue, navigation and shopping experience. Legal basis: legitimate interest or, where non-essential cookies are used, your consent (Articles 6.1.f and 6.1.a).
i) Compliance with legal requirements. Compliance with court decisions and requests from competent authorities, and the establishment and defence of legal claims. Legal basis: compliance with a legal obligation and legitimate interest (Articles 6.1.c and 6.1.f).
6. Retention periods
We retain your data for the following periods:
a) Customer and order data. For the duration of the commercial relationship and, once ended, for the limitation periods applicable to claims arising from the contract.
b) Invoicing and accounting data. Six (6) years pursuant to Article 30 of the Spanish Commercial Code, and four (4) years for tax purposes pursuant to the General Tax Act, the longer period prevailing.
c) User account data. For as long as the account remains active and until you request its deletion.
d) Data processed for marketing purposes. Until you withdraw your consent or object to the processing.
e) Customer care communications. For as long as necessary to handle the request and for the applicable limitation periods.
f) Browsing data and cookies. For the periods stated in the Cookie Policy.
Once those periods have elapsed, the data will be deleted or anonymised, unless it must be kept blocked and available to the competent authorities.
7. Recipients of the data
Your data may be disclosed to the following recipients, always on an appropriate legal basis:
a) Service providers acting as processors on behalf of IAMNUE: e-commerce platform, hosting, payment services, transport and logistics, customer care tools, marketing and analytics.
b) Financial institutions and payment service providers, for the processing of payments.
c) Carriers and customs agents, for the delivery of your order and export formalities where applicable.
d) Public authorities and courts, where there is a legal obligation to do so.
e) Professional advisers, within the scope of their duties and subject to a duty of confidentiality.
Data processing agreements as required by Article 28 of the Regulation have been entered into with all processors.
8. Relationship with Shopify
The website operates on the Shopify platform, which acts as data processor and hosts the Services, processing data relating to your access and browsing in order to provide and improve the service engaged by us.
In certain processing activities linked to advanced platform features, Shopify may act as an independent controller. You may consult its privacy policy and exercise any rights you may hold against that entity at privacy.shopify.com.
9. International transfers
Some of our providers are established outside the European Economic Area, which means certain processing activities may involve international data transfers.
Such transfers are covered by an adequacy decision of the European Commission or, failing that, by standard contractual clauses or other appropriate safeguards provided for in Chapter V of the Regulation.

10. Automated decisions and profiling
We carry out limited profiling in order to recommend products and display advertising tailored to your interests, based on your browsing and purchase history.
This processing is based on your consent and produces no legal effects concerning you nor similarly significantly affects you. We do not take decisions based solely on automated processing within the meaning of Article 22 of the Regulation.
You may object at any time by withdrawing your consent from the cookie settings panel or by writing to us.
11. Cookies
The website uses cookies and similar technologies. Cookies that are not strictly necessary are installed only with your consent, which you may give, refuse or withdraw at any time from the settings panel.

12. Your rights
You hold the following rights in relation to your personal data:
a) Access. To know what data of yours we process and to obtain a copy of it.
b) Rectification. To request the correction of inaccurate or incomplete data.
c) Erasure. To request the deletion of your data where it is no longer necessary or where any of the circumstances provided for by law apply.
d) Objection. To object to certain processing activities, in particular those based on legitimate interest and those carried out for marketing purposes.
e) Restriction. To request that processing be restricted in the cases provided for by law.
f) Portability. To receive your data in a structured, commonly used format and to request its transmission to another controller.
g) Withdrawal of consent. To withdraw at any time any consent given, without affecting the lawfulness of processing carried out beforehand.
The exercise of these rights is free of charge. We will not take any discriminatory measure as a result of your exercising them.
13. How to exercise your rights
You may exercise your rights by sending a request to customercare@iamnue.com or in writing to Doctor Fleming 24, bajo, 15005 A Coruña, Spain, stating the right you wish to exercise.
We may ask you to provide evidence of your identity where there is reasonable doubt as to it. We will respond within one month of receipt of your request, extendable by a further two months where the complexity or number of requests so requires, in which case we will inform you of the extension.
If you no longer wish to receive commercial communications, you may use the unsubscribe link included in every message.
14. Complaints
If you consider that the processing of your data does not comply with applicable law, you may first address your complaint to customercare@iamnue.com.
In any event, you are entitled to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos), C/ Jorge Juan 6, 28001 Madrid, Spain, at www.aepd.es, or with the supervisory authority of your place of residence.
15. Security
IAMNUE applies appropriate technical and organisational measures to ensure a level of security appropriate to the risk, having regard to the state of the art and to the nature of the data processed.
No system is, however, entirely invulnerable. We recommend that you do not send us sensitive information through insecure channels and that you keep your access credentials safe.
16. Children's data
The Services are not directed at minors and we do not knowingly collect their personal data.
If you become aware that a minor in your care has provided us with data, you may request its deletion at customercare@iamnue.com and we will remove it without delay.
17. Third-party links
The website may contain links to platforms operated by third parties, whose privacy policies are beyond IAMNUE's control. We recommend that you review them before providing them with personal data.
Information you share in public spaces or on third-party social media platforms may be visible to other users and lies outside our control.
18. Changes to this policy
This policy may be updated to reflect regulatory or operational changes or changes in our processing activities. The version in force will remain permanently accessible on this page, stating its date of update.
Where changes are substantial, we will notify you by the means provided for under applicable law.
